Terms and Conditions for Gymnastics Classes
These Terms and Conditions (the "Terms") govern the provision of gymnastics classes
and related services by Greystones Gymnastics Academy Limited (the "Academy") to the
parent or guardian (the "Parent") enrolling a child (the "Gymnast") in the Academy's
programmes. By enrolling a Gymnast in any class offered by the Academy, the Parent
agrees to be bound by these Terms.
BACKGROUND:
(A) The Academy provides Girls' Artistic Gymnastics classes for children aged 6 to 17
at various levels, from recreational to competitive team training.
(B) The Academy is committed to providing a safe, professional, and enjoyable
gymnastics environment for all Gymnasts.
(C) These Terms set out the rights and obligations of both the Academy and the Parent
in connection with the Gymnast's participation in the Academy's programmes.
IT IS AGREED as follows:
1. Definitions and Interpretation
1.1. In these Terms, the following words and expressions shall have the following
meanings:
"Academy" means Greystones Gymnastics Academy Limited, operating in Greystones,
County Wicklow, Ireland.
"Academy Director" means the individual responsible for the overall management and
coaching standards of the Academy, being Coach Marcel as at the date of these Terms.
"Academy Website" means the official website of the Academy as notified to Parents from
time to time, where the Calendar and other information are published.
"Business Day" means any day other than a Saturday, Sunday, or public holiday in Ireland.
"Calendar" means the schedule of classes, term dates, and closures published on the
Academy Website and updated from time to time.
"Class" means any gymnastics class, session, or training programme provided by the
Academy."Enrolment Form" means the form (whether in paper or electronic format) completed by
the Parent to register a Gymnast for a Class, including the check-in form and any
associated health declaration.
"Fees" means the monthly fees payable by the Parent to the Academy for the Gymnast's
participation in a Class, as notified by the Academy from time to time.
"GDPR" means the General Data Protection Regulation (EU) 2016/679 as it applies in
Ireland, together with the Data Protection Act 2018 and any successor legislation.
"Gymnast" means the child enrolled by the Parent in a Class offered by the Academy.
"Medical Certificate" means a certificate issued by a qualified medical practitioner
registered in Ireland or in an EU Member State.
"Parent" means the parent or legal guardian of the Gymnast who completes the
Enrolment Form and agrees to these Terms.
"Personal Data" has the meaning given to it in the GDPR.
"Programme" means the specific gymnastics programme in which the Gymnast is
enrolled, being one of Recreational, Advanced, or Team as described in Clause 3.
"Waiting List" means the list maintained by the Academy of prospective Gymnasts
awaiting a place in a Class.
1.2. In these Terms:
(a) references to clauses are to clauses of these Terms;
(b) headings are for convenience only and shall not affect the interpretation
of these Terms;
(c) words in the singular include the plural and vice versa;
(d) a reference to a statute or statutory provision includes any subordinate
legislation made under it and any modification, re-enactment, or
replacement of it from time to time; and
(e) any obligation on a party not to do something includes an obligation not
to allow that thing to be done.
2. About the Academy
2.1. The Academy provides Girls' Artistic Gymnastics coaching under the direction of
the Academy Director, Coach Marcel, who holds the following qualifications and
certifications:(a) certified coach with Gymnastics Ireland;
(b) certified coach with Gymnastics Canada;
(c) certified coach with Gymnastics Italy;
(d) over 30 years of international coaching experience;
(e) Garda Vetting certified in accordance with the National Vetting Bureau
(Children and Vulnerable Persons) Acts 2012 to 2016; and
(f) Sport Ireland Child Protection in Sport certified.
2.2. All coaching staff engaged by the Academy shall hold appropriate Garda Vetting
clearance and relevant child protection certifications as required by Irish law.
2.3. The Academy uses professional gymnastics equipment that meets international
safety certification standards.
3. Classes and Programmes
3.1. The Academy offers the following Programmes:
(a) Recreational Programme: for Gymnasts aged 6 to 12, focusing on
fundamental gymnastics skills in a fun and supportive environment;
(b) Advanced Programme: for Gymnasts aged 6 to 12, building upon
foundational skills with increased technical difficulty and conditioning;
and
(c) Team Programme: for Gymnasts aged 7 to 17, preparing Gymnasts for
performance gymnastics with intensive training and team participation.
3.2. Each Class is one hour in duration, held once per week, with four Classes per
calendar month.
3.3. The Academy maintains a coach-to-gymnast ratio of no more than 1:8 across all
Recreational Programmes.
3.4. Class timetables are set according to the sport centre's availability, Parent
preferences where practicable, and the Academy's organisational requirements.
The current timetable is available on the Academy Website.
3.5. The Academy reserves the right to:
(a) modify class timetables with reasonable notice to Parents;(b) cancel a Class due to unforeseen circumstances, including but not limited
to coach illness, facility unavailability, or severe weather conditions; and
(c) combine or restructure Programmes where the Academy considers it
appropriate for the development of the Gymnasts, provided that the
coach-to-gymnast ratio set out in Clause 3.3 is maintained.
3.6. Where a Class is cancelled by the Academy under Clause 3.5(b), the Academy
shall use reasonable efforts to offer a replacement Class or, at the Academy's
discretion, a pro-rata credit against the following month's Fees.
4. Enrolment and Acceptance
4.1. To enrol a Gymnast in a Class, the Parent must:
(a) complete the Enrolment Form in full, including all required health and
medical information;
(b) read and accept these Terms;
(c) provide a completed check-in form; and
(d) pay the applicable Fees.
4.2. Enrolment is not confirmed until the Academy has accepted the Enrolment Form
and the Parent has received written confirmation (which may be sent by email or
other electronic means) from the Academy.
4.3. The Academy reserves the right to refuse or defer enrolment at its discretion,
including where:
(a) the relevant Class is at full capacity;
(b) the Gymnast does not meet the age or skill requirements for the selected
Programme; or
(c) the Academy reasonably considers that the Gymnast's participation
would pose an unacceptable risk to the health or safety of the Gymnast
or other participants.
4.4. Where a Class is at full capacity, the Gymnast shall be placed on the Waiting List
and the Parent shall be notified when a place becomes available.
4.5. By completing the Enrolment Form and accepting these Terms, the Parent
confirms that they are the parent or legal guardian of the Gymnast and have the
legal authority to consent to the Gymnast's participation in the Academy's
Classes.5. Fees and Payment
5.1. Fees are payable monthly in advance. Payment is due on or before the 5th day of
each calendar month for that month's Classes.
5.2. The Academy shall notify Parents of the applicable Fees and any changes to the
Fees with at least 30 days' written notice.
5.3. Where payment is not received by the due date:
(a) the Academy may suspend the Gymnast's participation in Classes until
the outstanding Fees are paid in full; and
(b) the Academy reserves the right to offer the Gymnast's place to a person
on the Waiting List if payment remains outstanding for more than 14
days after the due date.
5.4. All Fees are inclusive of the benefits set out in Clause 17 (Membership Benefits).
5.5. The Academy may offer promotional rates, sibling discounts, or other fee
arrangements from time to time at its sole discretion. Any such arrangements
shall be communicated in writing.
6. Cancellation, Discontinuation and Refunds
6.1. A Parent wishing to discontinue a Gymnast's enrolment must provide the
Academy with at least 30 days' written notice (the "Notice Period").
6.2. Where the Parent fails to provide the required Notice Period, the Parent shall
remain liable for the Fees for the full Notice Period, whether or not the Gymnast
attends Classes during that period.
6.3. Upon discontinuation taking effect, the Gymnast's place may be offered to a
person on the Waiting List.
6.4. Subject to Clause 6.5, Fees paid are non-refundable for Classes that have been
made available during the relevant month, regardless of whether the Gymnast
attends.
6.5. Notwithstanding Clause 6.4, the Parent's rights under the Consumer Rights Act
2022 (as amended) and any other applicable Irish consumer protection legislation
are not affected by these Terms. Where the Parent is entitled to a refund under
applicable law, the Academy shall process such refund within 14 days of receipt of
a valid refund request.
6.6. The Academy may terminate a Gymnast's enrolment with immediate effect if:(a) the Gymnast or Parent materially breaches these Terms;
(b) the Gymnast's behaviour poses a risk to the safety or wellbeing of other
Gymnasts or coaching staff; or
(c) the Parent fails to disclose a material health or medical condition of the
Gymnast in accordance with Clause 11.
6.7. Where the Academy terminates enrolment under Clause 6.6, any Fees paid in
advance for Classes not yet provided shall be refunded on a pro-rata basis.
7. Attendance and Punctuality
7.1. Gymnasts are expected to attend all scheduled Classes. The Parent shall notify
the Academy as soon as reasonably practicable if the Gymnast is unable to attend
a Class.
7.2. Gymnasts must arrive on time for their scheduled Class. Late arrivals may not be
permitted to join the Class if, in the opinion of the coaching staff, joining the Class
after the warm-up has been completed would pose a safety risk.
7.3. Parents or authorised persons must check out the Gymnast punctually at the
conclusion of each Class. The Academy is not responsible for the supervision of
Gymnasts after the scheduled Class end time.
7.4. Parents are welcome to observe Classes from the designated viewing area.
Parents must not enter the training area or interfere with coaching activities
during a Class.
8. Make-Up Classes
8.1. Make-up Classes are available only where a Gymnast has missed a scheduled
Class due to illness or injury, and the Parent provides a Medical Certificate
confirming the reason for absence.
8.2. Requests for a make-up Class must be made within 7 days of the missed Class.
8.3. Make-up Classes are subject to availability and shall be scheduled at the
Academy's discretion.
8.4. No make-up Classes shall be provided for absences due to holidays, family
events, or other non-medical reasons.
9. Attire and Personal Items
9.1. Gymnasts must wear appropriate attire for all Classes, as follows:(a) a leotard or fitted t-shirt;
(b) leggings or gymnastics shorts;
(c) anti-slip socks or gymnastics shoes; and
(d) hair must be securely tied back away from the face.
9.2. Gymnasts must not wear jewellery, watches, hair clips with sharp edges, or any
items that may cause injury to the Gymnast or others during a Class.
9.3. The Academy accepts no responsibility for personal items brought to the
Academy's premises by Gymnasts or Parents. Valuable items should not be
brought to Classes.
10. Class Organisation and Equipment
10.1. Each Class is structured to include the following elements, as appropriate to the
Programme level:
(a) warm-up exercises;
(b) joint mobility and flexibility exercise;
(c) stretching;
(d) gymnastics skills development, which may include work on uneven bars,
balance beam, mini-trampoline, vault, and floor exercise;
(e) dance skills and choreography;
(f) cool-down exercises; and
(g) assessment and feedback.
10.2. The Academy uses professional gymnastics equipment that holds international
safety certifications. The Academy is responsible for the regular inspection and
maintenance of all equipment used in Classes.
10.3. The coaching staff shall determine the activities undertaken in each Class, having
regard to the Gymnasts' age, skill level, and safety requirements.
11. Health and Medical Conditions
11.1. The Parent must disclose all known health conditions, medical conditions,
allergies, disabilities, learning difficulties, and any medication taken by the
Gymnast on the Enrolment Form.11.2. 11.3. 11.4. 11.5. 11.6. 12. 12.1. 12.2. 12.3. 12.4. 12.5. The Parent must promptly notify the Academy in writing of any change in the
Gymnast's health or medical condition that may affect the Gymnast's ability to
participate safely in Classes.
Where the Academy has concerns about the Gymnast's fitness to participate in a
Class, the Academy may require the Parent to provide a Medical Certificate
confirming the Gymnast's fitness before allowing the Gymnast to continue
participation.
The Academy reserves the right to exclude a Gymnast from a Class if the
coaching staff reasonably considers that the Gymnast's participation would pose a
risk to the health or safety of the Gymnast or others.
In the event of an accident or medical emergency during a Class, the Academy
shall:
(a) administer first aid to the extent that trained staff are available;
(b) contact the emergency services if necessary; and
(c) notify the Parent as soon as reasonably practicable.
The Parent hereby authorises the Academy to seek emergency medical treatment
for the Gymnast in the event that the Parent cannot be contacted and a delay in
treatment could be detrimental to the Gymnast's health.
Assumption of Risk and Liability
The Parent acknowledges that gymnastics is a physical activity that carries
inherent risks of injury, including but not limited to sprains, strains, fractures, and
other musculoskeletal injuries.
The Parent acknowledges and accepts that the Gymnast participates in Classes at
the Gymnast's own risk, subject to the duty of care owed by the Academy under
Irish law.
The Academy shall take all reasonable precautions to ensure the safety of
Gymnasts during Classes, including maintaining appropriate coach-to-gymnast
ratios, using certified equipment, and employing qualified coaching staff.
Subject to Clause 12.5, the Academy's total aggregate liability to the Parent in
respect of any claim arising out of or in connection with these Terms shall not
exceed the total Fees paid by the Parent in the 12-month period immediately
preceding the event giving rise to the claim.
Nothing in these Terms shall exclude or limit the Academy's liability for:(a) death or personal injury caused by the Academy's negligence or the
negligence of its employees, agents, or contractors;
(b) fraud or fraudulent misrepresentation;
(c) any liability which cannot be excluded or limited by applicable Irish law,
including under the Civil Liability Act 1961 (as amended); or
(d) any other liability that cannot be excluded or limited under Irish law.
12.6. The Academy shall not be liable for any loss or damage to personal property
brought onto the Academy's premises by Gymnasts or Parents.
12.7. The Academy maintains appropriate insurance cover for its activities. Details of
the Academy's insurance arrangements are available upon request.
13. Parental and Guardian Responsibilities
13.1. The Parent shall:
(a) ensure that all information provided on the Enrolment Form is complete,
accurate, and up to date;
(b) (c) (d) notify the Academy promptly of any change in the Parent's contact
details;
ensure that the Gymnast attends Classes in the required attire as set out
in Clause 9;
ensure that the Gymnast is collected punctually at the end of each Class;
(e) inform the Academy of any changes to the Gymnast's health or medical
condition in accordance with Clause 11;
(f) ensure that the Gymnast's behaviour is consistent with the Code of
Conduct set out in Clause 14; and
(g) pay all Fees in accordance with Clause 5.
13.2. The Parent warrants that they have the legal authority to consent to the
Gymnast's participation in Classes and to agree to these Terms on behalf of the
Gymnast.
14. Code of Conduct
14.1. All Gymnasts are expected to:
(a) treat coaching staff and other Gymnasts with respect and courtesy;(b) follow the instructions of coaching staff at all times during Classes;
(c) use equipment safely and only as directed by coaching staff;
(d) not engage in any behaviour that may endanger the safety of themselves
or others; and
(e) respect the Academy's premises and equipment.
14.2. The Academy reserves the right to exclude a Gymnast from a Class, or to
terminate the Gymnast's enrolment, if the Gymnast's behaviour is disruptive,
dangerous, or otherwise inconsistent with the Code of Conduct.
14.3. Parents must conduct themselves respectfully when on the Academy's premises
and must not interfere with coaching activities or the participation of other
Gymnasts.
15. Photography and Video Policy
15.1. The Academy may from time to time take photographs or videos of Classes for
the following purposes:
(a) coaching and training review;
(b) promotion and marketing of the Academy including on the Academy Website;
and
(c) recording of achievements and assessments.
15.2. The Academy shall not photograph or video any Gymnast for promotional or
marketing purposes without the prior written consent of the Parent. Such consent
may be given on the Enrolment Form or by separate written authorisation.
15.3. The Parent may withdraw consent for the use of their Gymnast's image at any
time by giving written notice to the Academy. Upon receipt of such notice, the
Academy shall use reasonable efforts to remove the Gymnast's image from future
marketing materials, although the Academy cannot guarantee the removal of
images already in circulation on third-party platforms.
15.4. Parents and visitors must not photograph or video other Gymnasts during Classes
without the express permission of those Gymnasts' Parents and the Academy.
15.5. Any photographs or videos taken by Parents during Classes are for personal, non-
commercial use only and must not be published on social media or other public
platforms where other Gymnasts are identifiable, without the consent of the
relevant Parents.
16. Data Protection and Privacy
16.1. The Academy is a data controller for the purposes of the GDPR in respect of
Personal Data collected from Parents and Gymnasts.
16.2. The Academy collects and processes Personal Data for the following purposes:
(a) administration of enrolment and Class management;
(b) communication with Parents regarding Classes, Fees, and Academy
matters;
(c) health and safety management, including the maintenance of medical
information disclosed under Clause 11;
(d) compliance with legal obligations, including Garda Vetting, child
protection, and insurance requirements; and
(e) where the Parent has given consent, promotional and marketing activities
in accordance with Clause 15.
16.3. The legal bases for the Academy's processing of Personal Data are:
(a) the performance of the contract between the Academy and the Parent
(Article 6(1)(b) GDPR);
(b) compliance with legal obligations to which the Academy is subject (Article
6(1)(c) GDPR);
(c) the legitimate interests of the Academy in operating its business,
provided such interests are not overridden by the rights of the data
subject (Article 6(1)(f) GDPR); and
(d) consent, where applicable (Article 6(1)(a) GDPR).
16.4. Where the Gymnast is under the age of 16, the Academy shall obtain the consent
of the Parent before processing the Gymnast's Personal Data for the purposes of
information society services, in accordance with Article 8 of the GDPR and Section
31 of the Data Protection Act 2018.
16.5. The Academy shall implement appropriate technical and organisational measures
to protect Personal Data against unauthorised access, loss, destruction, or damage.
16.6. Personal Data shall be retained only for as long as is necessary for the purposes
for which it was collected, or as required by law. The Academy's data retention
periods are available upon request.
16.7. The Parent has the following rights in respect of Personal Data held by the Academy:
(a) the right to access Personal Data held about the Parent or the Gymnast;
(b) the right to rectification of inaccurate Personal Data;
(c) the right to erasure of Personal Data in certain circumstances;
(d) the right to restriction of processing in certain circumstances;
(e) the right to data portability; and
(f) the right to object to processing based on legitimate interests.
16.7. To exercise any of the rights set out in Clause the Parent should contact the Academy in writing.
16.8. The Academy shall respond to any such request within 30 days.
16.9. The Parent has the right to lodge a complaint with the Data Protection
Commission if they believe their data protection rights have been infringed. The
Data Protection Commission can be contacted at www.dataprotection.ie.
16.10. The Academy shall not transfer Personal Data outside the European Economic
Area without appropriate safeguards in place, as required by the GDPR.
17. Membership Benefits
17.1. The Fees paid by the Parent include the following membership benefits:
(a) Academy insurance coverage for the Gymnast during Classes;
(b) administration and enrolment fees;
(c) a small gift for the Gymnast after each Class;
(d) spare water available during Classes;
(e) regular equipment maintenance and safety inspections; and
(f) access to the Academy's Calendar and communications.
17.2. The Academy recommends that Gymnasts bring a healthy snack for consumption
before or after Classes. The Academy can provide guidance on suitable snack
options, including organic and vegan alternatives, upon request.
18. Complaints and Dispute Resolution
18.1. The Academy is committed to resolving any complaints promptly and fairly. Any
complaint should be directed to the Academy Director in writing.
18.2. The Academy shall acknowledge receipt of a complaint within 5 Business Days
and shall use reasonable efforts to resolve the complaint within 20 Business Days.
Where a complaint cannot be resolved within that period, the Academy shall
notify the Parent of the expected timeframe for resolution.
18.3. If a complaint is not resolved to the Parent's satisfaction, the Parent may refer
the matter to:
(a) the Competition and Consumer Protection Commission (CCPC) at
www.ccpc.ie; or
(b) mediation through an accredited mediation service.
18.4. Nothing in this Clause 18 affects the Parent's right to commence legal
proceedings.
19. General Provisions
19.1. These Terms constitute the entire agreement between the Academy and the
Parent in relation to the Gymnast's participation in Classes and supersede all
previous agreements, understandings, and arrangements between the parties,
whether written or oral.
19.2. The Academy may amend these Terms from time to time. The Academy shall
notify Parents of any material changes at least 30 days before they take effect.
Continued enrolment after the effective date of any amendment shall constitute
acceptance of the amended Terms.
19.3. If any provision of these Terms is found by any court or competent authority to be
invalid, unlawful, or unenforceable, that provision shall be deemed modified to
the minimum extent necessary to make it valid, lawful, and enforceable. If such
modification is not possible, the relevant provision shall be deemed severed from
these Terms, and the remaining provisions shall continue in full force and effect.
19.4. The failure of the Academy to enforce any right or provision of these Terms shall
not constitute a waiver of such right or provision.
19.5. These Terms, and any dispute or claim arising out of or in connection with them
(including non-contractual disputes or claims), shall be governed by and
construed in accordance with the laws of Ireland.
19.6. The courts of Ireland shall have exclusive jurisdiction to settle any dispute or
claim arising out of or in connection with these Terms.
19.7. The Academy may assign or transfer its rights and obligations under these Terms
to a successor or assignee, provided that such assignment does not materially
affect the Parent's rights under these Terms. The Parent may not assign or
transfer any rights or obligations under these Terms without the prior written
consent of the Academy.
19.8. A person who is not a party to these Terms shall have no rights under the
Contract (Privity) doctrine to enforce any provision of these Terms.
19.9. Notices under these Terms shall be in writing and may be delivered by hand, sent
by pre-paid post to the address provided on the Enrolment Form, or sent by email
to the email address provided on the Enrolment Form or by published on the Academy website.
